Authorizes custodians to deny public inspection of records created for purposes of pending or reasonably anticipated litigation involving the State, state agencies, political subdivisions, or their officers and employees acting in official capacity

Defines "reasonably anticipated litigation" as situations where concrete evidence indicates litigation is expected based on current facts and circumstances

Excludes court records and records pertaining to litigation that has been finally adjudicated or settled from the denial provision

Preserves discovery rights granted by statute or court rule for parties to litigation

Takes effect October 1, 2025
