Prohibits intentionally harassing, intimidating, or threatening another person while wearing a mask or face covering to conceal one's identity, when done with intent to cause reasonable fear of physical harm

First offense is a misdemeanor punishable by up to 90 days imprisonment, a fine up to $500, or both; second or subsequent offenses carry up to 180 days imprisonment, a fine up to $1,000, or both

Convictions under this section do not merge with other crimes arising from the same conduct and sentences may run consecutively

Affirmative defenses include masks worn for holidays/celebrations, occupational protective equipment, weather protection, theatrical productions, emergency situations, preventing spread of illness, or religious purposes
