Creates a new 10-year dismissal timeline for defendants found incompetent to stand trial who are charged with first-degree murder or first-degree rape, extending the current 5-year maximum for these most serious offenses

Maintains existing dismissal timelines: 5 years (or maximum sentence, whichever is lesser) for other felonies and crimes of violence; 3 years for all other offenses

Requires courts to provide advance notice and an opportunity to be heard to the State's Attorney and victims who have filed notification request forms before dismissing charges against incompetent defendants

Allows the State to petition the court at any time for extraordinary cause to extend the time before charges must be dismissed

Takes effect July 1, 2025
