Maryland Health Care Commission must maintain a registry of all artificial intelligence health software distributed or operated in the state, with regulations defining what qualifies as AI health software and setting registration deadlines.

Distributing or operating unregistered AI health software is prohibited, with fines up to $10,000 per day based on actual or potential harm, investigation costs, and violation history.

Health insurance carriers are prohibited from using artificial intelligence to decide or directly influence health care decisions or decisions directly related to health care.

Carriers may still use AI for tasks and decisions unrelated to health care.

Effective date: October 1, 2025.
