Prohibits manufacturing, selling, delivering, holding, or offering for sale food in Maryland containing any ingredient or additive banned by FDA regulations or other federal law or regulation

Originally listed specific banned substances (brominated vegetable oil, potassium bromate, propylparaben, Red 3) but amendments struck these to instead reference federal FDA prohibitions

Violations constitute a misdemeanor punishable by up to $10,000 fine and/or 1 year imprisonment for first offense, or up to $25,000 fine and/or 3 years imprisonment for repeat offenders

Civil penalties of up to $5,000 per violation may also be imposed, with each day of violation counting as a separate offense

Takes effect July 1, 2027
