Health care facilities performing surgical procedures must adopt and implement policies requiring smoke evacuation systems during procedures that may generate surgical smoke by January 1, 2028

Covered facilities include hospitals, limited service hospitals, related institutions, ambulatory surgical facilities, and freestanding medical facilities

Smoke evacuation systems must effectively capture and filter surgical smoke at the site of origin before it contacts the eyes or respiratory tract of room occupants

Surgical smoke is defined as gaseous by-products from energy-generating devices, including surgical plume, bio-aerosols, laser-generated airborne contaminants, and lung-damaging dust

Act takes effect October 1, 2026
