Sellers of pharmaceutical drugs or devices are prohibited from giving or offering gifts to health care professionals exceeding $50 total combined retail value per calendar year

"Gift" includes payments, food, entertainment, travel, subscriptions, advances, services, or anything else of value, but excludes peer-reviewed medical literature and items reimbursed at fair market value

"Health care professional" covers individuals licensed under the Health Occupations Article who can prescribe or recommend prescribed products, as well as their partnerships, corporations, officers, employees, agents, and contractors involved in health care provision

Violations constitute a misdemeanor punishable by a fine up to $5,000, imprisonment up to 6 months, or both
