Eligible governmental units participating in the Employees' Pension System, Law Enforcement Officers' Pension System, or Correctional Officers' Retirement System must enroll all applicable employees in that system, not just some employees.

Governmental units electing to participate must certify to the State Retirement Agency that they provided each employee eligible for optional membership with the necessary documentation to make their election.

Election documentation must include properly completed forms indicating whether each eligible employee intends to participate in or opt out of the applicable pension system.

Applies to counties, municipal corporations, and various other eligible governmental entities including fire departments, transit authorities, library commissions, and regional councils.

Takes effect June 1, 2026.
