Public Service Commission is prohibited from approving rate increases for water or sewage disposal companies if a county or municipality has commenced or indicated intent to commence eminent domain (condemnation) proceedings against the company

Fact finders in condemnation proceedings involving water or sewage disposal companies must consider reasonable system upgrades necessary for safe and reliable service

Fact finders must also consider the value to customers from potential reductions in water or sewer bills if the utility is acquired by a county or municipality through condemnation

Applies to privately owned water companies and sewage disposal companies regulated by the Public Service Commission
