Covered buildings that received a use and occupancy permit before June 1, 2022 are exempt from Maryland's building energy performance standards and energy use intensity targets until major systems require replacement

The exemption applies until lighting systems, HVAC systems, or other major building components fail or reach end of life and need replacement

Covered buildings under the existing law include commercial or multifamily residential buildings and state-owned buildings with 35,000+ square feet of gross floor area (excluding parking)

The underlying standards require a 20% reduction in net direct greenhouse gas emissions by January 1, 2030 and net-zero direct emissions by January 1, 2040
