Local jurisdictions in Maryland are prohibited from denying or restricting the operation of family child care homes and large family child care homes that meet State Department of Education licensing requirements.

Local jurisdictions cannot limit the number of children served below what the State Department of Education authorizes.

Local jurisdictions must designate family child care homes and large family child care homes as residential activities and permitted uses under residential zoning requirements.

The provisions apply to charter counties and Baltimore City, superseding any inconsistent local ordinances, resolutions, laws, or rules.

Effective date: October 1, 2026.
