Appointed members of county boards of education are prohibited from serving as president, vice president, chair, or vice chair of the board, though this does not apply to members appointed to fill vacancies for elected positions.

Members currently serving in leadership positions as of July 1, 2026, must vacate those positions by August 1, 2026.

County boards that violate this prohibition must remove the appointed member from leadership within 30 days of receiving written notice from the State Department of Education.

Non-compliant county boards face suspension of administrative funding, mandatory website posting of the violation, and potential referral to the Attorney General after 60 days.

Individual appointed members who knowingly continue serving in leadership positions may face civil penalties up to $2,500.
