Creates a new felony for distributing heroin, fentanyl, or their chemical analogues when the use results in death or serious bodily injury to another person

Applies only to individuals with a prior conviction for drug distribution or manufacturing under § 5–602 or § 5–603

Excludes sharing of these substances without payment from the definition of "distribute"

Imposes a penalty of up to 20 years imprisonment, to be served consecutively (not concurrently) with any other drug distribution sentences

Allows prosecution in either the county where the distribution occurred or where the death/serious bodily injury occurred; effective October 1, 2026
