MD HB1400

Authorizes suspension (up to 5 years for first violation) or revocation (for second or subsequent violations) of shellfish aquaculture harvester permits and registration cards for specific oyster harvesting violations

Covered offenses include: taking oysters more than 200 feet within a closed area, using prohibited gear, harvesting outside time restrictions by more than 1 hour, taking oysters from leased areas without authorization, and commercial harvesting without valid authorization

Requires the Department to hold an administrative hearing before suspending or revoking a permit or registration card

Prohibits any person with a suspended or revoked permit/registration card from engaging in any aquaculture activity during the suspension or revocation period, regardless of other licenses held

Takes effect October 1, 2026
