Landlords of apartment buildings with 4+ units must provide air-conditioning capable of maintaining temperatures at or below 80°F at 3 feet above floor level in habitable spaces from June 1 to September 30 annually

Requirements apply to newly constructed rental units beginning June 1, 2026, and to renovated units (with electrical or heating system upgrades) beginning October 1, 2026

Properties on the National Register of Historic Places are exempt from the requirements

For landlord-controlled AC systems, the landlord must maintain the temperature; for tenant-controlled systems, the landlord must ensure equipment is in good working order

Political subdivisions may enact stricter air-conditioning requirements than those established in this law
