Patuxent Institution and all State and local correctional facilities must maintain records on instances of items damaged or destroyed due to visible leakage of menstrual discharge from incarcerated individuals

Female incarcerated individuals cannot be subjected to disciplinary measures for items damaged or destroyed without malicious intent due to visible leakage of menstrual discharge

Applies to both the Patuxent Institution (Section 4-214) and local correctional facilities/Division of Correction facilities (Section 9-616)

The Maryland Commission on Correctional Standards will review facility policies and records relating to menstrual hygiene products during regular inspections
