Baltimore City Council may enact and the Mayor may enforce local laws regulating the sale and distribution of cigarettes, other tobacco products, and electronic smoking devices

Local laws must be at least as stringent as existing state provisions under the Business Regulation Article

Baltimore City cannot issue its own licenses under the relevant state titles or impose local taxes on cigarettes and other tobacco products (state licensing and taxation under Title 12 of the Tax-General Article remain exclusive)

Electronic smoking devices are subject to the same local authority, except Baltimore City cannot issue separate licenses for those products
