Exempts off-grid electricity providers from Public Utilities Article regulations, orders, and permits if their generating facility does not interconnect with the state electric system, does not cross state lines, and is not located within any federal, state, or local roadway or right-of-way

Off-grid electricity providers must still obtain certificates of public convenience and necessity under §§ 7-207 and 7-207.1 when constructing an electric generating facility

Applies only to off-grid electricity providers that begin generating, transmitting, distributing, or selling electricity on or after October 1, 2026

Providers lose their exempt status if their facility later interconnects with the state grid, crosses state lines, or becomes located within any roadway or right-of-way

Effective date: October 1, 2026
