County boards of education may adopt open enrollment policies allowing students to attend public schools in counties other than where they reside, free of charge

Enrollment preferences must be given to students zoned to the school and siblings of enrolled students; when applications exceed capacity, a lottery or other equitable selection process is required

Schools may deny applications for reasons including lack of capacity, inability to meet special needs, expulsion history, or compliance with desegregation plans

Sending counties must transfer to receiving counties the lesser of either county's local current expense per student; the state covers any difference if the receiving county's per-student costs are higher

County boards must publish open enrollment capacity reports by school and grade level on their websites, updated at least every 4 weeks; effective July 1, 2026
