Fixes the baseline date for calculating reimbursement rates to nonparticipating (out-of-network) health care providers at January 31, 2019, replacing the previous rolling "January 1 of the previous calendar year" standard

Requires HMOs to pay nonparticipating providers at least 125% of the average contracted rate as of January 31, 2019, adjusted annually by the Medicare Economic Index inflation factor from 2019 to the current year

Applies to both evaluation and management services and non-evaluation/management services provided by health care providers without HMO contracts

Maintains existing minimum payment floors, including 140% of Medicare rates for trauma physicians and Health Services Cost Review Commission-approved rates for hospitals

Takes effect October 1, 2026
