Employers cannot discipline, discharge, or discriminate against fire and rescue public safety employees for possessing a valid medical cannabis certification or testing positive for cannabis while holding such certification

Fire and rescue public safety employees covered include firefighters, emergency medical technicians, cardiac rescue technicians, and paramedics employed by municipal corporations, counties, the State, State Airport Authority, or fire control districts

Employers retain the right to prohibit employees from performing duties while impaired by cannabis and from using cannabis while on duty

Employers must report to the State Emergency Medical Services Board if a fire and rescue public safety employee reports for work while impaired by cannabis
