Repeals the blanket certificate of need (CON) exemption for bed capacity changes at intermediate care facilities offering residential or intensive substance use disorder treatment services

Creates a new CON exemption for establishing or operating intermediate care facilities offering medically managed residential substance use disorder treatment, subject to Commission approval

Requires 45 days written notice to the Commission before establishing such facilities or changing bed capacity at licensed medically managed substance use disorder treatment facilities

Commission must find the proposed facility or bed change is consistent with the State health plan, will deliver more efficient and effective health care, and is in the public interest

Effective October 1, 2026
