Expands the definition of damages in eminent domain condemnation proceedings to include legal fees, expert fees, and other costs incurred by the property owner (defendant), in addition to fair market value of the land taken

Amends Section 12–104 of the Real Property Article of the Maryland Annotated Code

Shifts the financial burden of litigation costs from property owners to condemning authorities when land is taken through eminent domain

Takes effect October 1, 2026
