Repeals Section 11-108 of the Courts and Judicial Proceedings Article, which currently caps noneconomic damages in personal injury and wrongful death lawsuits

Eliminates the existing cap structure that started at $500,000 in 1994 and increases by $15,000 annually on October 1st

Removes the 150% cap multiplier that applies to wrongful death cases with multiple claimants or beneficiaries

Applies prospectively only to causes of action arising on or after the effective date of October 1, 2026

Noneconomic damages include pain and suffering, disfigurement, loss of consortium, mental anguish, and loss of companionship (punitive damages excluded)
