Department of Public Safety and Correctional Services and the Judiciary must automatically expunge all eligible criminal cases by July 1, 2028, without requiring individuals to petition for expungement

Cases eligible for automatic expungement include those ending in acquittal, dismissal, nolle prosequi, or probation before judgment after 3 years, and most misdemeanor convictions after 7 years

Second-degree assault and domestically related crimes are excluded from automatic misdemeanor expungement

Beginning August 1, 2028, the Judiciary must identify newly eligible cases monthly and complete expungement within one month of notification to the Department

New criminal convictions during the 7-year waiting period pause eligibility until the new conviction itself becomes eligible for expungement
