Counties and municipalities are prohibited from banning short-term rentals solely because the operator is a lessee or sublessee rather than the property owner

Local governments may enact ordinances limiting lessees and sublessees to operating only one short-term rental within their jurisdiction

Short-term rentals are defined as residential dwelling units (including accessory dwellings) rented for less than 31 consecutive days, excluding hotels, motels, boarding houses, and student housing facilities

Property owners retain the right to prohibit or restrict their lessees and sublessees from using the property as a short-term rental through lease agreements
