Eligible governmental units may participate in the Employees' Pension System, Law Enforcement Officers' Pension System, or Correctional Officers' Retirement System only if all employees in the applicable category participate in that system.

Governmental units electing to participate must certify to the State Retirement Agency that they provided each eligible employee with the necessary documentation to elect optional membership.

Required documentation must include properly completed election forms indicating whether each employee intends to participate in or opt out of the applicable pension system.

Effective date of participation is July 1 of the year following the election; if documentation is not submitted on time, participation is postponed an additional year.

The bill takes effect June 1, 2026.
