Applications for certificates of public convenience and necessity for generating stations in "at-risk census tracts" must include a BURDEN (Baseline Understanding of Risk, Disparities, and Environmental Needs) report detailing existing environmental and public health burdens

At-risk census tracts are defined as areas within 1.5 miles of census tracts with EJ Scores at or above the 75th percentile, six or more environmental health indicators above the 75th percentile, or extreme proximity (95th-99th percentile) to mining operations, power plants, hazardous waste landfills, or concentrated animal feeding operations

Wind, solar, and geothermal energy generating stations are exempt from the BURDEN report requirement

The Public Service Commission must deny applications if approving would cause or contribute to adverse environmental or public health stressors higher than other areas in the state, unless the applicant demonstrates the project serves a public interest in the at-risk census tract
