Service agreements for residential property maintenance or sale entered into before June 1, 2023 are automatically void if the service provider has forfeited their right to conduct business in Maryland and is considered defunct/not in good standing with the State Department of Assessments and Taxation as of June 1, 2026

Pre-June 2023 agreements with defunct providers cannot be effective for more than 2 years, run with the land, bind subsequent purchasers, create liens on the property, or allow assignment without the property owner's consent

Property owners affected by a recorded service agreement that violates these provisions may sue in circuit court to have the agreement declared void and unenforceable

Successful plaintiffs may recover compensatory damages plus reasonable attorney's fees and costs
