Beginning January 1, 2027, recovery residences in Maryland must be certified by a Department-approved credentialing entity before operating, changing the current voluntary certification system to a mandatory requirement.

Recovery residences are defined as alcohol-free and drug-free housing for individuals with substance-related disorders, addictive disorders, or co-occurring mental disorders that do not provide clinical treatment services.

Recovery residences are exempted from behavioral health program licensure requirements under this bill.

Credentialing entities must conduct on-site inspections before issuing certificates and at least once during each 1-year certification renewal period, and must maintain updated lists of certified residences.

False advertising as a certified recovery residence carries civil penalties up to $1,000 per offense, with the Department considering factors including violation severity and ability to pay.
