Producers of electronic smoking devices (e-cigarettes, vape pens, electronic hookahs) must submit a stewardship plan to the Department of Environmental Protection by November 1, 2026 for collection, recycling, and disposal of unwanted devices

180 days after plan approval, producers cannot sell electronic smoking devices in Maine unless participating in an approved stewardship program

Collection system must include permanent locations within 15 miles of 90% of Maine residents within one year of program launch, with no fees charged to consumers for drop-off

Producers must finance all program costs including collection, transportation, recycling, education, and department oversight fees capped at $100,000 per year per program

Performance goals require either 50% public awareness by year 3 (70% by year 6) or 50% diversion from disposal by year 4, with annual reports and third-party audits required
