Authorizes Hemphill Farms, Inc. of Presque Isle to bring a civil lawsuit against the Department of Agriculture, Conservation and Forestry for claimed damages resulting from departmental actions

Waives the State's sovereign immunity defense under Maine Revised Statutes, Title 14, chapter 741, and overrides any applicable statute of limitations

Requires the lawsuit to be filed in Aroostook County Superior Court within one year of the resolve's effective date, with the option for a jury trial

Allows recovery of liability, damages, and punitive damages according to state law, as in litigation between private individuals

Requires the Attorney General to defend the action and conduct good-faith settlement negotiations, with the Treasurer of State responsible for paying any settlement or final judgment including costs and interest
