Contract provisions that indemnify or hold harmless a party from negligence, claims, or liability arising from intentional acts or omissions are declared void and unenforceable as against public policy

Applies to acts or omissions by the promisee, promisor, or their agents, servants, employees, or independent contractors

Contracts may still require a promisee to be included as an additional insured on an insurance policy

Workers' compensation insurance and other insurance contracts issued by licensed insurers are exempt from the prohibition

Applies to contracts entered into or renewed on or after January 1, 2026
