HB 4031 Summary

• Requires certificate from Department of Environmental Quality to establish or maintain flammable compressed gas or liquefied petroleum gas container filling locations.

• Requires certificate for aboveground flammable compressed gas or liquefied petroleum gas storage with tank capacity exceeding 2,000 gallons or multiple tanks with aggregate capacity exceeding 4,000 gallons.

• Requires certificate for aboveground flammable or combustible liquid storage with individual tank capacity exceeding 1,100 gallons, with exemption for crude petroleum wellhead collection tanks and farm storage tanks 1,100 gallons or less used for noncommercial motor fuel or heating oil.

• Allows Department of Environmental Quality to require approval before installation of aboveground storage tanks with capacity of 1,100 gallons or less, excluding farm tanks for noncommercial purposes.

• Mandates removal of aboveground storage tanks for flammable or combustible liquids that have not been in use for 3 years.
