The board must approve or disapprove assistance requests within 90 days of application, with ability to reconsider denials or waive the deadline upon written request by applicants.

Beginning July 1, 2009, applicants for Michigan Strategic Fund assistance must certify in writing that they will not knowingly hire or contract with businesses that knowingly employ individuals not authorized to work in the United States.

Beginning July 1, 2009, applicants must commit to hiring only Michigan residents or individuals planning to become residents, with limited exceptions for federal law compliance, key management personnel with special skills, and border county facilities where nonresident use would not significantly harm state employment.

Remedy provisions require revocation of financing, loans, or grants for violations of hiring requirements, and may require repayment of some or all benefits received.

The board must report annually to the legislature by February 1 on Michigan residents employed, jobs created, exemptions granted with specific reasons, and other relevant information.
