Effective July 1, 2009, applicants seeking funds from the transportation economic development fund must provide written certification that they will not knowingly hire or contract with businesses that employ individuals not authorized to work in the United States.

Beginning July 1, 2009, applicants must make a good faith effort to employ Michigan residents or individuals planning to become state residents, and to contract with Michigan firms for project construction, rehabilitation, and development.

Written agreements with applicants must include remedy provisions allowing for ineligibility for future fund financing and potential repayment of benefits if the applicant violates the employment authorization requirements.

Annual reports to the governor and legislature must include the number of Michigan residents employed in funded projects, details of good faith hiring efforts required of applicants, and other information evaluating program effectiveness.

The bill's effectiveness is conditioned on the enactment of Senate Bill No. 502 and Senate Bill No. 539 of the 95th Legislature.
