Beginning January 1, 2010, persons selling, distributing, or providing elemental mercury in Michigan must include a material safety data sheet as defined in 42 USC 11049.

Recipients of elemental mercury must sign a statement at receipt agreeing to use it only for medical, dental, research, or manufacturing purposes.

Recipients must certify they will store and use mercury safely to prevent undue exposure, with an exception that dental amalgam placement is not considered undue exposure.

Recipients must not dispose of mercury in solid waste or wastewater treatment systems, except dental practices may dispose of amalgam waste if collected and recycled per section 16631.

Recipients must retain signed statements for at least 3 years and make them available upon request to state, local, or municipal wastewater treatment representatives; dental amalgam placement is excluded from the requirements.
