MI HB4394

Prohibits a person from reading, manually typing, or sending text messages on a wireless 2-way communication device while operating a moving motor vehicle on a highway or street in Michigan, effective July 1, 2010.

Exempts emergency communications including reporting traffic accidents, medical emergencies, serious road hazards, personal safety threats, criminal activity, and official duties by police, law enforcement, firefighters, and emergency vehicle operators.

Establishes civil infraction penalties of $100 for a first violation and $200 for second and subsequent violations.

Preempts all local ordinances regulating wireless device use while driving, though local governments may adopt ordinances substantially corresponding to this state law.

Enactment is contingent upon passage of Senate Bill 468 and House Bill 4370 in the 95th Legislature.
