HB 4427 Summary

• Amends the Michigan Insurance Code to subject the Catastrophic Claims Association's board meetings to the Open Meetings Act (1976 PA 267, MCL 15.261-15.275) as if the board were a public body.

• Requires writings prepared, owned, or retained by the board in performing official functions to be subject to the Freedom of Information Act (1976 PA 442, MCL 15.231-15.246) as if the board were a public body.

• Clarifies that associations and facilities created under the Insurance Code are not state agencies and their money is not state money, even when complying with transparency requirements.

• Establishes catastrophic claims association liability thresholds for personal protection insurance coverage, with amounts increasing biennially beginning July 1, 2013 by the lesser of 6% or the consumer price index (rounded to nearest $5,000.00).

• Does not take effect unless House Bill No. 4471 of the 95th Legislature is enacted into law.
