Requires resident motor vehicles to have a paid recreation passport fee to enter designated state-operated public boating access sites, or display a registration tab showing the fee has been paid.

Requires nonresident and commercial motor vehicles to display a valid seasonal or daily pass affixed to the lower right-hand corner of the windshield to enter designated state-operated public boating access sites.

Establishes civil infraction penalties of up to $100 for violations, with exemptions for vehicles used in site operation, emergency vehicles, state vehicles, and law enforcement vehicles.

Directs the Department of Natural Resources to designate which state-operated public boating access sites require passes and to deposit all pass revenue into the waterways account.

Takes effect October 1, 2010, contingent on enactment of Senate Bill 388 and Senate Bill 389 of the 95th Legislature.
