Local governments must file proposed standards for mobile home parks or mobile homes that exceed state standards with the mobile home commission, which has 60 days to approve unless the standard is unreasonable, arbitrary, or not in the public interest.

Local government ordinances cannot be exclusionary to mobile homes, cannot have setup or installation standards more stringent than manufacturer specifications or federal HUD standards, and cannot impose roof configuration or special use zoning requirements that apply only to mobile homes.

Local governments may inspect rental mobile homes for safety within or outside mobile home parks if the same inspection applies to all other rental housing, with inspections no more frequent than every 3 years unless responding to tenant complaints.

Safety inspections of rental mobile homes are limited to furnace, water heater, electrical wiring, plumbing, ventilation, heating equipment, structural integrity, and smoke alarms, and cannot enforce construction standards exceeding federal HUD standards.

Effective date is January 4, 2010.
