Department of Corrections employees may request HIV or HBV testing of prisoners following percutaneous, mucous membrane, or open wound exposure to blood or body fluids within 72 hours of exposure.

Department must determine if reasonable cause exists for the exposure claim and if it qualifies under specified Michigan administrative code standards before testing the prisoner.

Department may test prisoners without consent or court order, and must notify the requesting employee of test results within 2 days, either directly or through their designated healthcare provider.

Test results and prisoner identity remain confidential under public health code provisions; unauthorized disclosure is a misdemeanor offense.

Department must report all positive HIV test results to the Department of Community Health and develop standardized request forms for employees; this act takes effect only if HB 4899 is also enacted.
