Prohibits automobile insurers and their affiliates from owning or acquiring ownership interests in motor vehicle repair facilities, effective upon enactment of the bill

Requires insurers that owned repair facilities on the effective date to divest all ownership interests by December 31, 2010

Mandates insurers disclose their ownership interests to policyholders in writing when policies are delivered, issued, or renewed, and verbally when claims are filed

Requires insurers to post notices in at least 18-point font at customer entrances of owned facilities informing customers they may seek repairs at facilities of their choice

Allows aggrieved persons, including repair facilities, to sue for injunctive relief for violations and entitles prevailing plaintiffs to recover reasonable attorney fees and court costs

Prohibits insurers from developing preferred repair facility lists or otherwise directing insureds to specific repair facilities
