Motor vehicle operators involved in an accident must remove the vehicle from the main traveled portion of the roadway to a safe location (shoulder, emergency lane, median, or off-road) if it is safe to do so and the vehicle can be operated normally without further damage or hazard.

The requirement applies only when the operator or another occupant with a valid driver license knows or reasonably should know that serious impairment of bodily function or death has not resulted from the accident.

Operators or occupants who move a motor vehicle from the roadway before police arrival are not presumed at fault for the accident solely based on moving the vehicle.

Evidence regarding whether an operator chose to move or not move the vehicle is inadmissible in civil actions as proof that serious bodily impairment did or did not occur.

Violation of this section constitutes a civil infraction.
