Extends storm water discharge permit fees until October 1, 2011, including one-time construction activity fees ($400), annual industrial/commercial fees ($260), and tiered annual municipal separate storm sewer system fees ($500-$7,000 based on population).

Establishes non-refundable application fees for new water discharge permits ranging from $75-$750 and annual permit fees for industrial, commercial, and municipal facilities discharging into surface waters, effective until October 1, 2011.

Requires permit fee payments to be made by specified deadlines (March 15 for storm water fees, January 15 for annual discharge permit fees) with 0.75% monthly interest assessed on late payments.

Allows department to return application fees and grant 15% annual discount on permit fees if the department fails to decide on permit applications within 180 days (new permits) or by September 30 of the following year (reissuance).

Permits municipalities to pass through application and annual permit fees to users of municipal facilities and allows facility owners to challenge annual permit fees through administrative procedures or contested case hearings.
