Local units of government cannot adopt ordinances that preclude federally licensed amateur radio service communications or fail to comply with 47 CFR 97.15 and federal communications commission rules.

Local units cannot restrict amateur radio antennas or antenna support structures below 90 feet in height unless clear and convincing evidence shows the restriction is necessary to achieve a defined health, safety, or aesthetic objective.

Any local ordinance regulating antenna placement, screening, number, or height must reasonably accommodate amateur radio service communications and constitute the minimum regulation necessary to carry out the governing body's legitimate purpose.

The section does not apply to districts organized for historic preservation purposes.
