Health maintenance organizations must file proposed contract or rate changes with the commissioner and wait 60 days before implementation unless the commissioner approves earlier in writing.

Commissioner has up to 60 days to notify the organization if the proposed change is illegal or unreasonable, with the option to request modifications or schedule a hearing within 30 days.

Commissioner must provide written findings of fact and conclusions within 30 days after any hearing regarding the proposed contract or rate change.

Contracts or rates resulting from collective bargaining that affect only bargaining group members are immediately filed with the commissioner and exempt from the 60-day waiting period.

Health maintenance organizations must provide affected subscribers at least 30 days' advance written notice of proposed changes, except when changes result from law or administrative/executive orders, in which case notice must be provided within 30 days after the effective date.
