Amends the Natural Resources and Environmental Protection Act to require property owners/operators of hazardous substance facilities to prevent contamination exacerbation, exercise due care in mitigating exposure hazards, and take precautions against third-party acts.

Persons violating these requirements are liable for response activity costs, natural resource damages from exacerbation, and fines or penalties, but not additional response activities unless otherwise liable under the Act.

Exempts the state and most local government units from these requirements, except school district boards and public school academy boards regarding property where school building construction or expansion occurs after April 29, 2010 if environmental assessment shows the property is a facility.

Defines "school building" as structures intended for pupil instruction (including additions) or recreational/athletic structures for pupil use, excluding playground or exercise equipment.

Bill takes effect only if House Bill 5271 is enacted into law.
