HB 6019 Summary

• Amends Section 1274 of the Revised School Code to expand procurement requirements for school districts, intermediate school districts, and public school academies to include services, insurance, utilities, third-party financing, equipment, and all other goods or services needed.

• Requires competitive solicitation for any procurement valued at $50,000 or more, with board approval required before entering into procurement contracts, with exemptions for emergency situations, declared states of emergency or disaster, and imminent threats to public health or safety.

• Establishes competitive bidding procedures for construction, repair, remodeling, or demolition contracts including requirements for newspaper advertising, posting on state website for at least 2 weeks, public bid opening meetings, and sworn notarized statements disclosing any familial relationships between bidders and board members or superintendents.

• Allows school districts to solicit competitive bids from the private sector whenever practicable and permits cooperative purchasing agreements without requiring competitive solicitation if another entity in the program previously used competitive solicitation for the same goods or services.

• Gives preference to Michigan-based businesses in all purchases when all other things are equal and consistent with federal law, and authorizes selection of architects, engineers, and professional service providers through competitive, qualifications-based selection processes.
