Qualified health plans offered through a state exchange cannot provide coverage for elective abortion, but individuals and employers may purchase optional supplemental coverage outside the exchange.

Health insurance policies and HMO contracts offered outside a state exchange cannot cover elective abortions except through an optional rider purchased with an additional premium.

Employers purchasing an optional rider for elective abortion coverage must ensure the rider cost is not factored into employee premium contributions and must notify employees that the coverage includes elective abortion.

"Elective abortion" excludes contraceptive use and abortion medically necessary to avert the woman's death as determined by a physician's reasonable medical judgment.

The section does not apply to Medicaid benefits, does not create a right to abortion, and applies to policies delivered or renewed in Michigan on and after the effective date.
